Welcome to MinePix. By accessing or using our Minecraft server, website, and related services (hereinafter referred to as the "Service"), you agree to these Terms of Service ("ToS"). If you do not agree to these terms, please refrain from using the Service.

1. Definitions

• Service: The MinePix Minecraft server, accessible via play.minepix.net, the website https://minepix.net, and all associated features including forums, in-game shops, and player accounts.
• User/Player: Any individual accessing or using the Minecraft server or related services.
• Account: The User's personal access credentials to the Service, linked to their Minecraft username and created through registration on our website.
• In-Game Content: Virtual items, currency, ranks, cosmetics, and other digital goods available within the Minecraft server.
• Partner: Third-party entities collaborating with MinePix, such as payment processors, hosting providers, or API services.

2. Acceptance of Terms

By using the Service, you confirm that:

• You are at least 13 years old or meet the minimum age required by the laws of your country.
• You own a legitimate copy of Minecraft: Java Edition.
• You have the legal capacity to enter into a contract with us.
• You agree to comply with all applicable local, national, and international laws while using the Service.
• You understand that this Service is not affiliated with or endorsed by Mojang Studios or Microsoft.

3. Service Description

MinePix provides a Minecraft multiplayer server with custom game modes, features, and community services. The Service includes:

• Access to Minecraft server gameplay
• Web-based player statistics and profiles
• In-game virtual economy and shop
• Community features such as forums and social interactions
• Premium ranks and cosmetic items

The Service is offered online and accessible from any device with a valid Minecraft: Java Edition client and Internet connection.

4. Account Creation and Management

1. Registration: To access premium features and track your progress, you must link your Minecraft account and provide accurate information when creating a website account.
2. Account Confidentiality: You are responsible for maintaining the confidentiality of your credentials and all activities conducted through your account. Do not share your account with others.
3. Minecraft Account: You must use your own legitimate Minecraft account. Using cracked, stolen, or unauthorized accounts is strictly prohibited.
4. Multiple Accounts: Creating multiple accounts to circumvent bans, gain unfair advantages, or exploit the system is prohibited.
5. Restrictions: We reserve the right to suspend or terminate any account that violates these ToS, Minecraft's EULA, or is used unlawfully.

5. In-Game Purchases and Virtual Items

1. Virtual Currency: Our server uses virtual currency that can be purchased with real money. This currency has no real-world value and cannot be exchanged for cash.
2. Ranks and Items: Premium ranks, cosmetics, and in-game items are digital goods with no monetary value outside the Service. These purchases grant access to features and content within our server only.
3. Payment Processors: Payments are processed through secure third-party payment processors. By making a payment, you also agree to the terms of our payment processor.
4. Non-Transferable: Purchased items, ranks, and virtual currency are non-transferable and cannot be sold, traded for real money, or transferred to other accounts.
5. Price Changes: We reserve the right to modify our prices at any time, with a notice period of 30 days for active subscriptions.
6. No Guarantee of Availability: We do not guarantee that specific items, features, or content will remain available indefinitely. Items may be modified, removed, or replaced.

6. Refunds Policy

7. Player Conduct and Server Rules

1. Prohibited Behavior: Users are strictly prohibited from:
   • Using hacked clients, cheats, mods, or exploits that provide unfair advantages
   • Harassment, bullying, hate speech, or discriminatory behavior toward other players
   • Spam, advertising, or promoting other servers
   • Scamming, stealing, or griefing other players (unless permitted in specific game modes)
   • Sharing inappropriate content or links
   • Impersonating staff members or other players
   • Attempting to hack, DDoS, or otherwise harm the server infrastructure
   • Exploiting bugs or glitches for personal gain (report them to staff instead)
   • Real-money trading (RMT) of in-game items or accounts
   • Using the Service for any illegal purposes
2. Allowed Mods: Performance and cosmetic mods (e.g., OptiFine, shaders) are generally allowed. Mods that provide gameplay advantages or automate actions are prohibited.
3. Chat and Communication: Keep communication appropriate for all ages. We reserve the right to moderate, filter, or remove any content.
4. Reporting: Players are encouraged to report rule violations to staff members through appropriate channels.
5. Consequences: Violations may result in warnings, temporary bans, or permanent bans depending on severity.
6. Legal Compliance: Users must comply with all applicable laws, Minecraft's EULA, and Microsoft's Terms of Service.

8. Intellectual Property

1. Server Ownership: All rights, titles, and interests related to the Service, including but not limited to custom plugins, builds, website design, logos, and content, remain the property of mrPixBro.
2. Minecraft: Minecraft is a trademark of Mojang Studios and Microsoft Corporation. We are not affiliated with, endorsed by, or associated with Mojang Studios or Microsoft.
3. User Content: Any content you create on the server (builds, chat messages, etc.) may be moderated, removed, or used for promotional purposes.
4. License to Use: We grant you a non-exclusive, non-transferable, and revocable license to use the Service for personal, non-commercial entertainment purposes only.
5. Restrictions: You may not copy, modify, reverse engineer, or create derivative works of our custom plugins or server software.

9. Limitation of Liability

1. Service "As-Is": The Service is provided "as-is" without warranties of any kind. We do not guarantee uninterrupted gameplay, error-free operation, or preservation of in-game data.
2. No Liability for Loss: We are not liable for any loss of virtual items, currency, ranks, progress, or in-game data due to bugs, server resets, maintenance, or technical issues.
3. Exclusions: We are not liable for any damages arising from your use or inability to use the Service, including but not limited to lost profits, data loss, or computer damage, except in cases of intentional misconduct or gross negligence, to the fullest extent permitted by applicable law.
4. Server Availability: We do not guarantee continuous availability. The server may be taken offline for maintenance, updates, or technical issues without prior notice.
5. Third-Party Actions: We are not responsible for the actions of other players, including harassment, scamming, or griefing.
6. Force Majeure: We are not responsible for interruptions caused by circumstances beyond our reasonable control, including but not limited to hosting provider issues, DDoS attacks, or natural disasters.
7. Limitation Amount: In jurisdictions that do not allow the exclusion of liability, our total liability shall not exceed the amount you paid to us in the past 12 months.

10. Account Termination and Bans

1. By You: You may request account deletion at any time through your user dashboard or by contacting support. Refund eligibility is subject to our Refund Policy.
2. By Us: We reserve the right to suspend or permanently ban your account for:
   • Violation of these Terms of Service or server rules
   • Cheating, hacking, or use of unauthorized modifications
   • Toxic behavior, harassment, or hate speech
   • Chargebacks or payment fraud
   • Any activity that harms the server, its community, or its reputation
3. Ban Appeals: If you believe a ban was issued in error, you may submit an appeal through our designated appeal process. We reserve the right to accept or deny appeals at our discretion.
4. Effect of Termination: Upon termination, you lose access to all purchased items, ranks, virtual currency, and account data. Refunds may be considered within our standard 14-day refund period as outlined in our Refund Policy.
5. Ban Evasion: Attempting to evade a ban by creating new accounts or using VPNs will result in permanent bans of all associated accounts.

11. Personal Data and Privacy

MinePix respects your privacy. We collect, use, and protect your personal data in accordance with our Privacy Policy.

Data we may collect includes:

• Minecraft username and UUID
• IP address and connection information
• Gameplay statistics and in-game activity
• Purchase history and transaction data
• Chat logs and player reports (for moderation purposes)

Users in the EU have the right to access, rectify, or delete their data under the GDPR. You may also lodge a complaint with your local data protection authority. To exercise your rights, contact us at support@minepix.net.

12. Server Modifications and Updates

We reserve the right to:

• Modify, add, or remove game modes, features, and content at any time
• Perform server resets or wipes (with advance notice when possible)
• Change the balance, pricing, or availability of items and ranks
• Update server rules and policies to maintain a healthy community

Major changes that affect purchased items will be communicated in advance when feasible. We strive to preserve the value of your purchases during updates.

13. Changes to the Terms of Service

We reserve the right to modify these ToS at any time. Users will be notified at least 30 days in advance of any material changes via email, in-game announcements, or website notices. Continued use of the Service after changes take effect constitutes acceptance of the revised ToS.

14. Governing Law and Jurisdiction

For EU residents, these ToS are governed by the laws of your country of residence. For other users, the governing law will be the laws of Ukraine. Disputes shall be resolved in the competent courts of Somecity, Ukraine, unless otherwise required by applicable consumer protection laws.

15. Minecraft EULA Compliance

MinePix operates in compliance with the Minecraft End User License Agreement (EULA). We do not sell gameplay advantages or "pay-to-win" features. All purchases are for cosmetic items, ranks with non-gameplay affecting perks, or server support.
